The Federal High Court in Abuja has dismissed the bail application of Tukur Mamu, the alleged negotiator in the Abuja-Kaduna train attack case, who is facing terrorism charges.

The court cited a counter-affidavit filed by the Department of State Services (DSS), which claimed that Mamu posed a flight risk and had the potential to commit further crimes if released on bail.

Justice Inyang Ekwo noted that the defendant had failed to challenge the security agency’s averments that he had the capacity to commit a further crime if released on bail.

The court held that facts admitted need no further proof, and where averments in a counter-affidavit are not countered, they are accepted to be true and correct.

The court also rejected Mamu’s claims about his health issues, stating that there was no concrete evidence to support them.

The court noted that adequate tests and treatments were administered to Mamu at the Arewa Specialist Hospital and Diagnostic Center, Jabi, and he was diagnosed with Moderate Obstructive Sleep Apnea.

The court further noted that Mamu refused medical services provided by the DSS and insisted on going to his preferred hospital for treatment.

The court held that the DSS was willing to cater to Mamu’s health needs, but he insisted on going to his choice hospital for treatment.

The court’s decision to deny Mamu bail is expected to strengthen the Nigerian government’s resolve to tackle terrorism in the country.

The case highlights the need for the Nigerian government to strengthen its counter-terrorism efforts and improve security measures to prevent attacks on citizens and infrastructure.
