Supreme Court Orders FG to Pay Allocations Directly to LGs, Bars Governors from Dissolving Councils

In a landmark judgement, the Supreme Court of Nigeria has issued a directive compelling the Federal Government to disburse allocations directly to Local Government (LG) councils, effectively bypassing state government control. This decision, delivered on Thursday, marks a significant step towards granting financial autonomy to the 774 local government councils across the country.

The apex court’s ruling comes in response to a suit filed by the Attorney General of the Federation (AGF), challenging the governors’ authority to arbitrarily dissolve democratically elected LG councils. The suit, which raised 27 grounds of contention, underscored the constitutional rights of local governments to manage their affairs independently.

Justice Emmanuel Agim, delivering the lead judgement, criticized state governors for their historical resistance to granting autonomy to LG councils. The Supreme Court’s decision not only bars governors from dissolving elected councils but also mandates that funds allocated from the Federation Account be paid directly to the LGs. This move aims to enhance transparency and accountability in local governance, ensuring that resources intended for grassroots development are utilized efficiently.

The ruling is expected to have far-reaching implications for governance practices in Nigeria, emphasizing the judiciary’s role in upholding the rule of law and safeguarding democratic principles. By granting financial autonomy, the Supreme Court seeks to empower LG councils to address local development challenges effectively and independently.
