The Independent National Electoral Commission (INEC) in Nigeria has been granted permission by the Court of Appeal in Abuja to reconfigure the Bi-modal Voter Accreditation System (BVAS) machines. These machines were used for the presidential and National Assembly elections on February 25th across the country. The court decision was made after opposition candidates, who had placed second and third behind the All Progressives Congress (APC) candidate, Bola Tinubu, in the presidential election, requested access to electoral materials as they prepared to file petitions challenging the outcomes of the election in court.
The court granted the opposition candidates access to the materials and ordered INEC to upload the data on the BVAS machines to the back-end server, providing certified true copies of the data to the respondents. However, INEC was instructed not to tamper with the machines pending the inspection conducted by the candidates.
As a result of the decision, INEC will be able to proceed with the governorship and state assembly elections scheduled for March 18th. These elections were originally slated for March 11th but had to be postponed to allow for the reconfiguration of the BVAS machines.
